Welcome to Video.ai! These Terms and Conditions ("Terms") govern your use of our application ("App") and its services. Please read them carefully.

1. Acceptance of Terms

By creating an account or using the Video.ai App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the App.

2. Eligibility

You must be at least 18 years old to use this App. By creating an account, you represent and warrant that you meet this age requirement.

3. App Services

Our App provides AI-powered video and image generation services. We offer both consumable virtual credits ("Tokens") and auto-renewing subscription plans to access these services.

4. Consumable Tokens

To create videos on certain modes, you must use "Tokens," which are the virtual credits used within the App. Tokens can be acquired through one-time in-app purchases or promotional offers. Tokens are not real-world currency, have no monetary value, and are non-refundable and non-transferable.

If a video generation task fails due to an internal server error or a fault in our system, the Tokens used for that specific task will be automatically refunded to your account balance.

5. Permitted Use

You agree to use the App responsibly and ethically. You may only upload images of yourself or individuals from whom you have obtained explicit, verifiable consent. You are strictly prohibited from using the App to create content that:

• Violates any individual's privacy or publicity rights.
• Depicts minors (individuals under 18 years of age).
• Is sexually explicit, pornographic, violent, hateful, or otherwise offensive.
• Infringes on the copyrights, trademarks, or intellectual property of others, including the likenesses of celebrities or public figures without authorization.

6. Subscriptions, Auto-Renewal, and Cancellation

We offer Weekly and Monthly auto-renewing subscriptions, as well as a Lifetime one-time purchase. Subscriptions grant you unlimited generation access for the duration of the subscription period.

• Billing: Subscription payments will be charged to your iTunes Account (Apple App Store) or Google Account (Google Play Store) at the confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew at the same price and billing duration (weekly or monthly) unless auto-renew is turned off at least 24 hours before the end of the current billing period.
• Account Charge: Your account will be charged for renewal within 24 hours prior to the end of the current billing period, identifying the cost of the renewal.
• Subscription Management: You can manage your subscriptions and turn off auto-renewal at any time by going to your Account Settings on the App Store (for iOS/macOS) or Play Store (for Android) after purchase.
• Refunds: All purchases and subscriptions processed through the respective app stores are final and subject to their billing terms. Except as required by applicable law, purchases are non-refundable.

7. User Content, License, and Data Handling

You retain all ownership rights to the images you upload ("User Content"). However, by using the App, you grant Video.ai a limited, non-exclusive, worldwide, royalty-free license to temporarily use, store, and process your User Content solely for the purpose of generating your requested video.

• Input Images: Your uploaded images are used only for the generation process and are deleted from our systems promptly after the video is created.
• Generated Videos: All generated video content is automatically and permanently deleted from our servers 24 hours after its creation is complete. It is your responsibility to download and save any content you wish to keep before this period expires.

8. AI-Generated Content Disclaimer

The videos produced by the App are generated by artificial intelligence. The results are synthetic and may contain artifacts or inaccuracies. We do not guarantee the realism or quality of the output and are not responsible for any interpretation or use of the AI-generated content.

9. Prohibited Activities

You agree not to:

• Impersonate any person or entity.
• Upload any illegal, malicious, or harmful material.
• Use generated content to bully, harass, defame, or threaten anyone.
• Attempt to reverse-engineer, decompile, or otherwise disrupt the App or its AI systems.

10. Account Termination

We reserve the right to suspend or terminate your account and delete your data at our sole discretion, without notice or liability, for any reason, including but not limited to a breach of these Terms.

11. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without any warranties, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, Video.ai and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App, including any harm caused by your misuse of the generated content.

13. DMCA / Takedown Policy

We respect intellectual property rights. If you believe your likeness or copyrighted content has been used without your consent, please contact us at mail.imotion.ai@gmail.com with sufficient evidence. We will promptly investigate and take appropriate action.

14. Modifications to Terms

We may modify these Terms from time to time. We will notify you of any major changes. Your continued use of the App after such modifications constitutes your acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law principles.

16. Apple App Store EULA and Disclaimer

The following terms apply if you obtain the App from Apple's App Store:

• You acknowledge that these Terms are concluded between you and Video.ai only, and not Apple. Apple is not responsible for the App or its content.
• Your use of the App is subject to Apple's standard Licensed Application End User License Agreement (EULA), which can be found at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.
• Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
